The News Broadcasters Association (NBA) is all set to file a fresh case in High Court against the Telecom Regulatory Authority of India (TRAI) on December 16, 2013.

According to the sources close to the development, the decision was taken at a meeting of the NBA members on December 12 after the case was dismissed by the Telecom Disputes Settlement and Appellate Tribunal (TDSAT).

In an earlier interaction with exchange4media, NBA’s General Secretary, Annie Joseph, has said, “Going by the Supreme Court order that is the option we have, which we have to discuss and decide.”

As is known, on Wednesday TDSAT had dismissed the 10+2 ad cap case filed by NBA and other broadcasters such as B4U, 9X Media and E24. Now, all the petitioners need to directly go to the High Court for all hearings against the recommendations of TRAI regulations.

The Tribunal’s ruling came after the Supreme Court on December 6, 2013 ruled, “TDSAT has no power to interfere in TRAI’s recommendations.”

Meanwhile, in another development, Tis Hazari court has summoned broadcasters to be present in court on December 16 to get bail in a case filed by TRAI against these broadcasters for violating the ad cap rule.
