SC allows Republic to move HC on ratings matter
The apex court has directed the channel to approach the Bombay High Court in its plea against Mumbai Police's FIR in the TRP manipulation case
The Supreme Court has given Republic TV and its editor-in-chief Arnab Goswami the nod to approach Bombay High Court for quashing Mumbai Police's FIR in the TRP manipulation case.
Justice D. Y. Chandrachud has directed the channel to approach the High Court either under 226 or 482 (CrPC).
"We are also concerned about the fact that of late there has been a tendency of the Commissioners of Police to start giving interviews", observed the apex court.
The court also pointed out that the scope of 226 is wider than 32, making a case for the channel to approach the HC instead of the Supreme Court.
It also stated that entertaining the channels petition in the Supreme Court without the intervention of the High Court may not be appropriate.
The Mumbai Police has claimed that some channels were manipulating the TRP system, naming Republic TV, Fakht Marathi and Box Cinema.
