The Supreme Court has not stayed Madras HC Judgement on the TRAI's Interconnect Regulation and Tariff order, sources have told exchange4media. The matter has now been scheduled to come up on 28 August for consideration of interim prayers.
Star India had filed a fresh Special Leave Petition on 4 July which was listed for 20 July.
Also yesterday, the Delhi High Court adjourned Tata Sky and Airtel's writ petitions to 3 August.
On May 23, 2018, the Madras High Court, in general, had upheld the validity of the tariff order and the Telecommunication (Broadcasting and Cable) Interconnection (Addressable Systems) Regulations, 2017 after a split judgement passed by the Division Bench, on 2 March 2018, and a reference was made to the third judge.
The tariff order (Telecommunication (Broadcasting and Cable) Services (Eighth) (Addressable Systems) Tariff Order, 2017) upheld by Madras High Court came into effect on July 3.
“The Telecommunication (Broadcasting and Cable) Services (Eighth) (Addressable Systems) Tariff Order, 2017 and the Telecommunication (Broadcasting and Cable) Interconnection (Addressable Systems) Regulations, 2017 as upheld by the Hon’ble Madras High Court and the Telecommunication (Broadcasting and Cable) Services Standards of Quality of Service and Consumer Protection (Addressable Systems) Regulations, 2017 comes into effect from 3rd July 2018,” the regulator had said.
The Authority further had said that it has duly filed an affidavit before the Delhi High Court in compliance to the direction of the High Court, in its order dated August 29, 2017.
